Should I worry about who is at fault?

A: We never take anything for granted. We know that pproximately 2/3rds of motorcycle/auto collisions are caused by the inattention of automobile drivers. Every driver is legally required to?be in control of his/her vehicle at all times and to keep a proper lookout for vehicles around them. When a driver does not?follow these laws and they cause and injuries, they can be held legally responsible for damages and compensation.

However, most drivers (and many jurors) have had the experience of not seeing a motorcyclist and having a near miss. This means they tend to be sympathetic to the inattentive driver, unless there is clear evidence presented on how and why this wreck could have been prevented by the driver of the automobile.  This may require the use of experts, physical evidence, photographs of the scene, testimony of eyewitnesses, and ultimately the sworn testimony of the negligent driver.
